For Sellers

(This includes onboarded NGOs, Institutes & Organisations working with specially-abled and marginalised communities and independent artists who have been onboarded to showcase their catalog and get access to the Artist Bank)

1. Role of Made By Special

  • Made By Special (MBS) is a catalog and connecting platform created to increase visibility and access for institutes working with specially-abled individuals and marginalised communities.
  • MBS:
    • Hosts product catalogs
    • Enables buyer discovery
    • Facilitates direct 100% transparent connection between buyers and sellers
  • MBS does not participate in pricing, payments, production, shipping, or dispute resolution.

2. Catalog Representation

  • Sellers are responsible for providing accurate product descriptions, images, cost and contact details.
  • All information shared must be truthful and up to date.
  • MBS reserves the right to edit, pause, or remove catalog listings that are misleading or inconsistent with the platform’s values.

3. Pricing, Payments & Orders

  • All pricing decisions are made solely by the seller.
  • Sellers must communicate payment terms clearly to buyers before order confirmation.
  • Payments are received directly by the seller into their own bank accounts.
  • MBS does not collect, hold, or process payments.

4. Packaging, Shipping & Delivery

Sellers are fully responsible for:

  • Product quality
  • Packaging standards
  • Shipping and courier selection
  • Shipping charges must be communicated clearly and are typically borne by the buyer.
  • Sellers must provide buyers with shipping receipts or tracking details after dispatch.

5. Quality, Damage, Returns & Refunds

  • Sellers are solely responsible for product quality and workmanship.
  • Any damage, defects, delays, or losses must be resolved directly between seller and buyer.
  • Return, refund, and exchange policies are defined and managed by the seller.
  • MBS does not intervene in disputes or claims.

6. Ethical Conduct & Transparency

  • Sellers are expected to engage with buyers ethically, respectfully, and transparently.
  • All commitments regarding timelines, quantities, and customisation must be honoured.
  • Any misuse of the Made By Special name for misleading claims may result in delisting.

7. Limitation of Liability

Made By Special shall not be held responsible for:

  • Financial transactions
  • Product quality or delivery
  • Buyer-seller disputes
  • Legal or compliance issues arising from sales
  • All responsibilities lie with the seller.

For Onboarded Entities collaborating with Artists

(This includes onboarded NGOs, Institutes & Organisations working with specially-abled and marginalised communities and independent artists who have been onboarded to showcase their catalog and get access to the Artist Bank)

  1. Role of Made By Special
  • Made By Special (MBS) operates the Artist Bank as a connecting and discovery platform that enables institutes and artists to identify and reach experienced trainer artists for workshops and vocational skill training.
  • MBS:
    • Does not recommend or assign trainers
    • Does not negotiate fees or terms
    • Does not manage workshops, payments, or logistics
    • All engagements are conducted directly and independently between the hiring party and the trainer artist.

2. Initiating Contact

  • Institutes or artists may reach out to trainer artists directly using the contact details provided.
  • All communication must clearly reference Made By Special to maintain transparency.
  • When initiating contact, the hiring party should share:
    • Purpose and agenda of the workshop
    • Number of participants
    • Location and preferred language
    • Duration
    • Online or offline format

3. Agreement & Scope of Work

  • The hiring party is responsible for clearly defining:
    • Scope of work
    • Deliverables
    • Timelines
    • Participant details
  • All terms, conditions, and expectations must be agreed upon in writing before confirmation.
  • MBS is not a party to any agreement formed between the hiring party and the trainer artist.

4. Fees, Payments & Expenses

  • Trainer artists will share a quote based on the agreed scope.
  • The hiring party is responsible for:
    • Paying professional fees
    • Material costs (if applicable)
    • Travel, accommodation, food, and commute expenses (if applicable)
  • All payments must be made directly to the trainer artist as per mutually agreed terms.
  • MBS does not process or guarantee payments.

5. Logistics & Execution

  • Workshop logistics, venue arrangements, materials, and coordination are the responsibility of the hiring party unless otherwise agreed.
  • Any travel or accommodation commitments must be honoured as per discussion.

6. Professional Conduct & Respect

  • Hiring parties are expected to engage respectfully, inclusively, and ethically with trainer artists.
  • Clear communication and fair treatment are essential, particularly when working with specially-abled or marginalised individuals.

7. Cancellations & Changes

  • Any cancellations, postponements, or changes must be communicated directly to the trainer artist in advance.
  • Compensation, if applicable, must follow the mutually agreed terms.
  • MBS is not responsible for losses arising from cancellations or changes.

8. Limitation of Liability

  • Made By Special shall not be held responsible for:
    • Workshop quality or outcomes
    • Payment disputes
    • Travel or logistical issues
    • Cancellations or misunderstandings
    • All risks and responsibilities lie with the hiring party and the trainer artist.

9. Use of the Made By Special Name

Made By Special may be referenced only as the connecting platform.

The MBS name may not be used to imply endorsement, guarantee, or supervision of workshops.

10. Artist Bank – Workshop related

Any misuse of the Artist Bank for unsolicited promotions or illegal purposes may result in removal and legal action.
